Important Notesโ€‹

Conditional Waivers:

  • Effective only upon actual receipt of payment
  • Safer for contractors/suppliers
  • Use for progress payments (not final)
  • This template uses the California statutory form per Civil Code ยง8132

California Requirements:

  • California requires use of statutory waiver forms (Civil Code ยงยง8132-8138)
  • Non-statutory forms may be void and unenforceable under Civil Code ยง8120
  • No notarization required in California
  • Four statutory forms exist โ€” make sure you use the correct one for your situation

Best Practicesโ€‹

  1. Always use conditional waivers until payment has cleared your bank
  2. Specify exact amount and through date
  3. Ensure the waiver amount matches the payment amount
  4. Get waivers from your subs before signing yours
  5. Keep copies in your project files
  6. Track all waivers in a log
  7. Never waive more than you're being paid
